Anti-spam policy

EASYMAILING CLOUD SERVICES, S.L. (hereinafter, "EASYMAILING") establishes this Anti-Spam Policy to ensure the legitimate use of its email marketing Platform, protect its customers' sending reputation, and comply with applicable regulations on electronic commercial communications — in particular the Spanish Act 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE, Ley de Servicios de la Sociedad de la Información y de Comercio Electrónico), Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD, Ley Orgánica de Protección de Datos y Garantía de los Derechos Digitales), and Directive 2002/58/EC (ePrivacy).

For the purposes of this Policy, unsolicited email (spam) means any commercial communication sent by email without the prior, express, informed, free, and unambiguous consent of the recipient, or without an equivalent legal basis that legitimises its sending.

EASYMAILING maintains a zero-tolerance policy towards spam, both for legal reasons and because of the negative impact spam has on the sending reputation of all its customers.

Customer monitoring and verification

To ensure proper use of the service and compliance with our Anti-Spam Policy, we monitor the activities of our customers. We also verify new customers to prevent them from using our service to send unsolicited messages, as such actions damage our reputation and the reputation of other companies using our service. Another reason for monitoring platform usage is to maintain good standing with Internet service providers and major blocklists.

For these reasons, we may take some time to approve an account before allowing use of our service, and we may suspend or cancel an account if our spam policy or the platform's terms and conditions of use are breached.

Procedures used to determine whether spam has been sent:

  • Review of message content.

  • Review of subscriber lists to check whether they have been harvested, purchased, or rented.

  • Monitoring of all complaints via abuse reports.

  • Review and verification of the customer's registration data.

  • Checking membership on blocklists.

  • High bounces rate.

  • Abuse complaints.

Service use rules

Not allowed:

  • Purchasing or renting third-party databases.

  • Harvesting email addresses from websites.

  • Sending messages unrelated to the interests for which subscribers signed up.

  • Adding an email address to an audience without the subscriber's permission.

  • Sending an email to someone who has requested to be removed from your audience.

  • Multi-level marketing.

  • Affiliate marketing.

  • Emails that violate applicable regulations on electronic commercial communications, including the Spanish Act 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD), Directive 2002/58/EC (ePrivacy), the CAN-SPAM Act (USA), CASL (Canada's Anti-Spam Legislation), or any other anti-spam regulation applicable in the recipient's jurisdiction.

  • Campaigns offering the sale of illegal goods or services.

  • Generating mass content using artificial intelligence tools with the aim of bypassing spam filters, creating fake identities, impersonating third parties, producing deepfakes, or spreading disinformation. The use of AI features integrated in the Platform is permitted solely to assist the CUSTOMER in the legitimate creation of communications, with the CUSTOMER remaining ultimately responsible for the content sent.

Allowed:

  • Sending communications to recipients who subscribed via a web form with double opt-in.

  • Sending communications to recipients who gave their consent by means of a checkbox. This checkbox must not be pre-ticked; the person completing the form must give explicit consent to receive communications.

  • Sending any other communication that has been specifically requested (transactional emails, password reminders, order confirmations, etc.).

  • Offline forms, such as surveys or competitions — communications may only be sent to these individuals if they were informed they would be contacted by email and if they ticked a box indicating they wish to be contacted.

Account suspension

We reserve the right to suspend the CUSTOMER's account and open an investigation if their campaigns show signs of non-consensual sending, including but not limited to:

  • Spam complaint rate above 0.2% (a stricter threshold than the 0.3% recommended by major providers such as Gmail, Yahoo, or Microsoft, to preserve sending reputation).

  • Hard bounces rate above 5%.

  • Unsubscribes rate above 1%.

  • Combination of a low open rate (below 5%) with other indicators of unsolicited sending.

  • Any other reasonable indication that communications are being sent without adequate consent.

If, following the investigation, it is confirmed that the CUSTOMER has sent communications without the required consent, EASYMAILING may proceed to permanently cancel the account. If the CUSTOMER demonstrates that it holds the recipients' consent, the account will be reactivated and the service may resume normally.

Refund policy

If your Easymailing account is suspended due to a breach of this Anti-Spam Policy or any of the platform's terms and conditions of use, no refund will be issued for the subscription or contracted service payment.

The Easymailing team monitors our customers' activities to ensure full compliance with our Terms and Conditions. If you receive an unsolicited email, please contact us by completing the form at https://easymailing.com/reportar-abuso or via our support chat.

Your information will help us verify any possible breach of our anti-spam and acceptable use policies.

Easymailing spam policy

  • Easymailing users are required to comply with our anti-spam policy. Should any Easymailing user send unsolicited emails, their account will be immediately suspended and an investigation will be opened by our team.

  • EASYMAILING acts as a data processor with regard to data imported by the CUSTOMER into the Platform. Responsibility for the lawfulness, accuracy, and currency of such data rests with the CUSTOMER as data controller. EASYMAILING only accesses, modifies, or communicates this data on the CUSTOMER's instructions, by legal obligation, or in the cases set out in our Privacy Policy and Terms and Conditions of Use. Recipients of communications who wish to exercise their data protection rights must contact the sender (EASYMAILING's CUSTOMER) directly.

  • All Easymailing users must upload their own list in accordance with applicable legislation.

By clicking the UNSUBSCRIBE button, you will be automatically removed from the list and will receive a confirmation email. If the unsubscribe link does not work correctly, please notify us immediately by completing the form at https://easymailing.com/reportar-abuso or via our support chat. The absence or concealment of the unsubscribe link is a violation of our Terms and Conditions of Use.
